In pursuance of His Excellency's instructions

I beg respectfully to submit some observations on the letter of

Fia Honour the Chief Justice of the 10th instant.

1.

The first question arises is whether appeals to the

New Appeal Court are to lie from the Original Jurisdiction only.

I agree with the Chief Justice that the existing Full Court sho

should be retained for appeals from Swmary Jurisdiction and I

would add from decisions of Magistrates.

As to interlocutory matters in appeals to be ultimately heard

by the New Court and appeals from the Chief Justice in Chambers

the question I think to be decided is whether such appeals may

lie to the existing Full Court in the first instance with an

ultimate right of arpeal to the New Court, or whether such ap-

peals should with certain possible exceptions lie to the New

Court direct. The delay thus involved in the trial of the

action to which the Chief Justice refers is undoubtedly a matter

for consideration but questions of paramount importance may

arise on appeals from the Chief Justice in Chambers in cases

within the Original Jurisdiction and I think to deprive a liti-

gant of the right of appeal to the New Court in such cases would.

in a measure defeat the object in view.

A good deal in my opinion may be fairly urged in favour of trans

-ferring as far as possible the sole Appellate Jurisdiction to

the New Court excluding the matters to which I have alluded and

possibly certain interlocutory matters. The chief argurient

against it is that there will not be available time during the

bi-annual visit of Sir H. de Sausmarez but the argument of time

would not avail in so far as the congestion of the Court work here is concerned because the time occupied by the existing Full

Court inhearing appeals would be wailable for other purposes.
